The "Parties" have entered into this “Agreement” as follows:
1. OBJECT OF THE CONTRACT
1.1
The Landlord shall provide the Tenant with a furnished and fully
equipped apartment - Studio ..... located at Tähtvere 48,
Tartu 51007 under the conditions and within the term specified in the
Agreement.
1.2 this Agreement is the only legal basis for the use
of the object, equipment and inventory of the Agreement, which the
Landlord provides to the Tenant for use in a condition known to the
parties on the day of entry into force of the Agreement.
1.3 The
Landlord consents to the Tenant registering a new residence in Tartu and informs the co-owner. The Landlord has an unlimited co-owner Authorization to enter into an Agreement with the Tenant. Appendix no. 1. Authorization.
2. OBLIGATIONS OF THE LANDLORD
2.1
to make the object of the Agreement available to the Tenant for one
month from September 1, 2024, which will be extended for the
following months until June 30, 2025. Upon termination of the
Agreement, the Parties shall inspect the apartment and confirm the
termination of the Agreement.
2.2 provide the Tenant with the
following utilities: electricity, water, sewerage, garbage
collection, internet connection. The Landlord is not responsible for
the errors of the service providers.
2.3 maintain at its own
expense the current technical condition of water supply, sewerage,
electrical systems.
3. OBLIGATIONS OF THE TENANT
3.1
use the object of the Agreement in accordance with the purpose of its
use.
3.2 to pay as an advance payment, monthly to the Landlord, the fixed monthly price by the 1st day of month according to the contract. The fixed monthly price includes all costs and utility taxes, including electricity. The apartment is heated with electricity and the internal temperature is regulated automatically and permanently with wifi +20 degrees. If the resident wants a higher interior temperature of the apartment, +1 degree = €10 is added to the monthly price. If the Tenant leaves temporarily, he or she shall notify the Landlord in advance, who, if necessary, makes minor repairs and regulates the temperature of the apartment. The Tenant must also inform in advance the Landlord of any guest staying in the apartment. Guests staying until 3 days are free,
longer guests pay 10 € / day, which will be added to the monthly
bill. In the long term, the apartment is suitable for one resident.
3.3 keep the object of the Agreement in order so
that its value does not decrease. It is necessary to clean the apartment regularly according to the instructions on the wall, especially the sinks, toilet bowl, shower faucet and odor lock. If you are not constantly cared and it is no longer in order you will be reimbursed for the cost of things, example toilet bowl of 150 €. It is not allowed to bring your own
furniture and relocate existing furniture. You only need personal
belongings to move in, you can come with a "suitcase".
3.4
notify the Landlord immediately of any accident, fire, breakage, etc.
that has occurred in the object of the Agreement, repair or renewal
is not permitted, the Landlord shall do so.
3.5 to fully
compensate the Landlord for the damage / loss caused by the Tenant's
fault or use intentionally or unintentionally in the object of the
Agreement by the 01th day of the following month.
3.6 comply with
the rules of procedure of Tartu Student Home. Smoking, parties /
events, pets are not allowed. The night rest is from 23:00 to 07:00. Use of outdoor terrace, garden, yard by prior arrangement.
3.7 enable the Landlord to check the condition of the utility
systems of the object of the Agreement and the fulfillment of other
obligations under the Agreement in accordance with the prior
notification to the Tenant.
3.8
notify the Landlord of payment difficulties immediately in order to
discuss the situation and find a solution.
3.9 comply with the
rules of keeping dogs and cats of the city of Tartu if it is desired
to keep a pet in the object of its Agreement. Written consent of the
Landlord required for keeping a pet.
3.10 do not smoke in the
rooms. All apartments are non-smoking. If necessary, smoke in the
agreed places in street.
3.11 immediately after the expiry of the
term of the Agreement to vacate the surface of the object of the
Agreement. If desired, enter into a new Agreement for a new term.
4. RIGHTS OF THE LANDLORD
4.1
demand early termination of the Agreement and removal of the Tenant
if:
4.1.1 The Tenant uses the object of the Agreement in conflict
with what is agreed in the Agreement.
4.1.2 The Tenant destroys
or damages the premises, furniture, household appliances or plumbing
equipment. The tenant uses electrical accessories, which increases the electricity cost, and the tenant does not agree to pay for the additional electricity cost.
4.1.3 The Tenant is late in paying the rent to the
Lessor for more than 1 (one) day or does not pay according to the
invoice. Payment must be made by bank transfer on the last day of the
previous month / first day of the beginning month. On the penultimate day of
the month, the Landlord sends an invoice to the Tenant's e-mail
stating the next month's payment.
5. RIGHTS OF THE TENANT
5.1
to use the object of the Agreement, its furnishings, public premises,
equipment, inventory.
5.2 require its guests to comply with the
rules of procedure and respect for customs, failing to inform the
Landlord immediately.
6. VALIDITY OF THE AGREEMENT
6.1
The Agreement enters into force from the moment of its signing
together with the payment of the first monthly price.
6.2 The
Agreement shall be terminated upon expiration by removal, payment of
debts / damages, elimination of damages, transfer of keys and
confirmation of the termination of the Agreement by date and
signatures.
6.3 before the expiry of the term, the Agreement may
be terminated:
6.3.1 By agreement between the Landlord and the
Tenant.
6.3.2 At the initiative of the Landlord or the Tenant by
notifying thereof in writing 1 (one) month in advance.
6.4
Immediately, the Tenant has the opportunity to terminate the
Agreement if he offers a new student to the surface of the object of
the Agreement, with whom the Landlord enters into the Agreement in
advance.
7. CONFIRMATIONS BY THE CONTRACTING PARTIES
7.1
The Parties confirm that the Parties are legal entities and have full
legal rights and powers to perform the obligations assumed under the
Agreement.
7.2 The Landlord confirms that the object of the
Agreement is its property on the basis of the right of ownership.
7.3 The Landlord confirms that until the conclusion of this
Agreement, the object of the Agreement has not been transferred to
anyone, no disputes have arisen in this respect and third parties do
not have any rights in relation to the object of the Agreement.
8. DISPUTES
8.1
Disputes and claims arising between the Parties in connection with
the performance, amendment, termination or interpretation of the
Agreement shall be resolved through negotiations between the Parties.
8.2 in the event that the above-mentioned disputes cannot be resolved
through negotiations, the dispute shall be resolved in the court of
the location of the Landlord or in an arbitration court established
by agreement of the Parties.
9. LIABILITY OF THE PARTIES
9.1
The Parties shall bear full and material responsibility for the
fulfillment of the terms of this Agreement.
9.2 With this
Agreement, the Landlord is not responsible for the preservation of
the Tenant's personal property.
9.3 The Tenant does not
live in debt and the Landlord does not demand interest on arrears.
From the moment of non-payment according to the Agreement, the Tenant
shall pay the Landlord 5 € / day in addition to the rent until the
termination of the Agreement by signing the Agreement.
9.4 The
Landlord has the right to disclose the Tenant's debt on the website
if the Landlord deems it necessary and all other possibilities for
receiving the debt have been exhausted.
10. FINAL PROVISIONS
10.1
The terms and conditions of the Agreement may be changed only by
written agreement of the Parties.
10.2 The rights and obligations
arising from the Agreement apply to each user of the object of the
Agreement.
10.3 The Agreement has been prepared and signed in two
copies, of which 1 copy remains for each party.
10.4 The
price list is updated according to the price list on the Internet of
the object of the Agreement (Tartu Student Home),
http://hillsidehouse.voog.com/student-home
, of which the Landlord notifies the Tenant in writing 1 (one) month
in advance. The pictures on the website reflect the current condition
of the apartment, furniture, inventory on the day of renting and are
the basis for the termination of the Agreement.
10.5 Necessary
conditions for concluding the Agreement by the Tenant is an ID card / passport (+copy) and payment of the reservation/deposit on the basis of the invoice by transfer immediately. Monthly payments are by transfer based on invoices previous month last day / first day of the starting month. The price of the reservation/deposit is a compensation for possible damages. The cancellation fee is a fixed price for one month.
10.6 The Parties acknowledge and
confirm that they understand and agree to the terms and conditions of
this Agreement and the Estonian / English language versions.
